Financial Collateral Arrangements in International Banking Law

The dissertation is devoted to analysis of the contemporary legal framework of financial collateral arrangements in international banking law. The author firstly addresses the mechanics of collateral in different financial transactions, collateral’s types and forms, essential purposes and benefits. Chapter II of the dissertation deals with the European legal framework concerning financial collateral arrangements. The Chapter continues with the analysis of the UK’s case of implementation of the Financial Collateral Directive, including the questions of interpretation, the related amendments to the UK’s legislation, as well as certain landmark cases. Finally, the Geneva Securities Convention and the national approach of the Russian Federation to the financial collateral arrangements is explored. The last chapter of the dissertation is exclusively devoted to the principles of conflicts of law related to financial collateral arrangements existing in the EU and internationally. The dissertation concludes with the study of the conflict of laws rules of the Russian Federation.
