Private Law Aspects of Cross-border Child Abduction

The dissertation is devoted to the analysis of such an interesting phenomenon of the international family law as cross-border child abduction. The author deals, firstly, with the existing international agreements aimed at prevention of and combating with this legal phenomenon, and, secondly, with the relevant case law including the Russian one. After examining accumulated case law and theoretical material, the author comes to the conclusion that it is of pivotal importance for the effective and operative implementation of the international agreement that national courts construe their provisions in autonomous and consistent manner. At the same time, the paper points at some inconsistencies and problems actual for application of the conventions by courts.
