The Principle of Good Faith in Property Law

On the example of the analysis of the standard of behavior formed by the judicial practice of a bona fide buyer, a bona fide mortgagee, a bona fide buyer of the pledged property, the author attempts to determine the specifics of the application of the principle of good faith in property law. As a result of the study, it was revealed that the standard of behavior of these persons formed by judicial practice is clearly overstated, which leads to negative consequences for the entire turnover as a whole. In order to ensure the most effective application of the principle of good faith in property law, the author proposed a number of legislative amendments, as well as a guideline for the development of judicial practice.
