Fair Trial: The Right to Qualified Legal Asistance (in Light of Article 6 of the European Convention on Human Rights)

This work is devoted to the analysis of the practice of the ECHR regarding the observance of the right to access to qualified legal assistance in the context of Article 6 of the European Convention on Human Rights. In the introduction the relevance of research in the chosen direction is revealed, the goal and objectives of the study are set, the object and the subject of scientific research are defined, the methodological basis of the study is indicated. In the first chapter are examined the concept and features of a fair trial, as well as the concept and essence of qualified legal assistance. In the second chapter are examined the main aspects characterizing violation of the right to access qualified legal assistance in civil and criminal cases. In addition, the practice of the ECHR regarding rights of lawyers as an integral part of the right to judicial protection is analyzed. The conclusion is devoted to the main conclusions on the stated topic of the work.
