Procedural Means of Combatting Abuse of Right of Application to International Tribunals

The master's thesis is devoted to the problem of bad faith in the exercise of the right to apply to the international tribunals and the lack of procedural means to combat it. The author analyzes the statutes and case materials of the international tribunals, as well as the relevant doctrinal studies and conducts a comparative analysis of the approaches of national courts and international investment arbitration. A number of conclusions and proposals to address the problem of abuse of the right of apply to the international tribunals have been formulated as a result of the thorough examination of said theoretical basis and court practice.
