The Status of a Lawyer in the National Criminal Procedure: History and Current State

The paper is devoted to the research of evolutionary stages of formation of Bar, that is considered from the moment of its emergence till present. Also an assessment of the current state of the national Bar in connection with the changes in the criminal procedure legislation is given. The central issue was the independence of the defender, who undertook to protect the person prosecuted. Having researched the history of formation of this institute in the Russian Federation and having compared it with legislation of foreign countries we concluded that we need to introduce to the criminal procedure additional rights for the lawyer to collect proofs in a criminal case.
