The Principle of Good Faith and its Importance for Procedural Legal Relations

For many years, the principle of good faith has been one of the most relevant scientific discourses. One group of scientists pays tribute to him, while another expresses its concerns. It is only obvious that its path of formation, which began in the era of Roman law, continues and continues. The principle of good faith undergoes certain difficulties of consistent implementation and sustainable development, because of abundance of forms of expression: custom, morality, written law, judicial law-making on the one hand and limited possibilities of legal technology - on the other. This work seeks to identify positive and negative trends in the course of the metamorphosis of the principle of good faith. The research offers ideas for transforming the Russian legal order in terms of striving for a unified concept of good faith in private law, civil proceedings and bankruptcy procedure. The result of the research is a comprehensive historical-legal, comparative-legal, theoretical-legal, civilistic material and procedural understanding of the unified principle of good faith.
