Keywords: migrant worker, migration policy, labor market, attraction of foreign citizens and legal status. In the current economic situation, the use of foreign labor for Russia is one of the possible sources of replenishment of declining labor resources. The Russian Federation is interested in the influx of workers from abroad, but at the same time it is necessary to create clear and transparent conditions for their attraction, and to develop effective methods of regulation there when using foreign labor. However, this problem cannot be solved without a thorough analysis of theoretical and practical problems. The development of the concept of the legal status of foreigners, clarification of the content of all its elements, as well as problems with its implementation, will allow the scientific substantiation of possible ways to improve the regulatory framework governing public relations in order to ensure the rule of law and identify specific areas for improving the legislation of the Russian Federation in the use and attraction foreign labor. Subject of research: social relations that are formed in the sphere of realization of labor rights of foreigners in Russia are evaluated in theoretical and practical aspects. The subject of the study: the norms of the Constitution of the Russian Federation, administrative and legal norms of the Russian Federation governing the legal status of foreign workers, social and labor relations and the use of foreign labor, judicial practice and scientific literature related to the topic of the study. Purpose of work: Analysis of the existing legislative base and judicial practice with the aim of developing theoretical and practical provisions aimed at improving administrative and legal regulation and attracting foreign workers in Russia. Research method: various analysis methods were used, historical, comparative legal, logical and analytical, systemic structures, analysis of normative acts, study and analysis of scientific literature. The structure of the study consists of an introduction, three chapters connecting eight paragraphs, a conclusion, a list of sources and applications used. This design of the study is due to the fact that, in principle, questions regarding the legal status of foreigners in Russia are mainly of a theoretical nature. In the first chapter, “General Characterization of the Legal Status and Regulation of the Labor of Foreigners in the Russian Federation,” the concept of legal status and its features are described, an essential part of this chapter is the study of the definitions used in the work. The second chapter, “Features of attracting labor of foreign workers in the Russian Federation”, which is a logical continuation of the previous chapter, contains provisions on the fundamental rights, freedoms and duties of foreigners, as well as on the peculiarities of concluding an employment contract and liability for violation by Russian workers of Russian laws. The third chapter, “Actual problems of regulating the labor of foreign workers and ways to overcome them,” is devoted to the problems of using the labor of foreign workers in Russia and abroad. Recommendations are given to improve the regulatory framework of the labor legislation of the Russian Federation.
