Civil Liability Of The Person Controlling The Credit Organization

The research paper discusses the civil-law liability of persons controlling credit institutions, including peculiar features of both subsidiary liability and an action for damages (which covers a claim for damages submitted in the course of a bankruptcy proceeding of a credit institution). The author draws conclusions about the impact of the status of a credit institution on civil-law liability of persons controlling credit institutions, including the circle of responsible persons, the amount of liability and special grounds for both bringing of a controlling person to responsibility and for liability release. The study provides an analysis of relevant court practice and provides actual data on key figures for the liability of persons controlling credit institutions in Russian Federation.
