Problems of Proving Authorship of Photo and Video Materials in the Courts of the Russian Federation

In this paper, the author analyzes the doctrine, current domestic legislation and judicial practice related to the protectability of photo and video files, their legal protection and subsequent protection in court against violation of exclusive copyright by third parties. The analysis of judicial practice shows a decrease in the standards of creative nature for copyright objects. The widespread distribution of photo and video materials on the Internet leads to an increase in the number of copyright violations of photo and video works. In this regard, the number of lawsuits related to copyright protection in arbitration courts has increased many times. Thus, the author suggests ways to solve these problems in this paper, by analyzing modern judicial practice and existing foreign doctrine.
