The Ways to Maintain a Balance between the Interests of a Patent Holder and the Public Interest in the Field of Pharmacy

This work is devoted to the study of existing ways to maintain a balance between the interest of a patent holder and the public interest in the field of pharmacy in Russia and foreign legal systems (USA, European Union, India). The paper considers the ways to protect the rights of the holders of pharmaceutical patents, types of abuse of exclusive rights in the pharmaceutical field and proposed ways to confront such abuses, the causes and mechanisms of restricting the exclusive rights of drug manufacturers in the public interest, as well as other mechanisms used to balance the interests of society and pharmaceutical companies. Based on the study, the author offers a number of solutions to improve the system of protecting the exclusive rights of patent holders in the pharmaceutical field.
