Alternative Obligations According to the Russian Civil Law

To date, the legal construction of an alternative obligation, which provides for the possibility of choosing between the pre-agreed parties to the options for execution, is of particular relevance, which may be beneficial to both parties to the obligation. Legal regulation of alternative obligations remains rather meager, which indicates the need to improve civil law. The research problems are the lack in the doctrine of the definition of an alternative obligation, reflecting all its essential features; insufficiently developed provisions on the structure and content of the alternative obligation; the need for a clearer delineation of alternative obligations with related legal structures (such as optional obligations); insufficiency of theoretical provisions on the emergence, fulfillment and termination of alternative obligations. In order to solve these problems, a deep theoretical analysis of the concept, characteristics, structure and content of alternative obligations is presented. Distinctions of alternative obligations from optional are highlighted. Suggestions for improving legislation in this area are formulated.
