Objects of Patent Rights and Their Legal Regime under Russian Law

Following degree paper is a comprehensive study of the patent law legal regime in terms of russian legislature. It is necessary to conduct a thorough research due to the rapid development of various technologies, leading to an increase in the share of the intellectual property market in the Russian economy. At the same time, there are certain problems in the legal regulation of relations involving objects of patent rights, as well as in the theory of patent law, the resolution of which will contribute to the stabilization and growth of this sector in the economy. In the course of the research, an analysis of domestic and foreign legislature in the field of patent law, theoretical work, as well as the practice of Russian courts was conducted. The main features and peculiarities of the legal nature of the patent right objects are distinguished, the definition of the concept of the patent rights object is proposed by the author and the timeline of their emergence defined. Moreover, the characteristics of each type of patent rights objects are considered, a new warranty for the patentability of a utility model is proposed. The analysis of the procedure for state registration of patent rights, the nature and content of these rights, and features of the patent rights legislature in foreign legal systems was carried out. Scientific novelty of the research is justified by: distinction of methods solving theoretical and practical problems, proposition of patent rights objects classification and research of correlation of the all aspects in terms of the patent law legal regime.
