The purpose of the study was to determine the criteria for the helpless state of the injured person in crimes against sexual integrity and sexual freedom, as well as in other crimes encroaching on the person and her interests. For a deeper analysis, a comparative analysis of approaches to determining the criteria for a helpless state by the legislators of other countries was carried out. An attempt was made to justify the need to establish the dependence of the victim on the guilty person in determining a helpless state.
