The ongoing socio-economic transformations in modern legislation significantly affect civil law relations, including relations that are developing regarding the protection of property rights and other property rights. The lack of unity of judicial practice on the procedure for applying existing methods of protecting property rights and other property rights, as well as the repeated cancellation by the higher courts of the Russian Federation of decisions of lower instances, cannot but indicate the relevance of the analyzed topic and its insufficient study. The purpose of this research is to identify and analyze the problems of legal regulation of ways to protect property rights and other proprietary rights to real estate, study the practice of applying these rules by judicial authorities and develop recommendations to address the relevant gaps in legislation and interpretation of law.
