Musical Compositions and Phonograms. Legal Aspects of Making Contracts with Authors / Performers and Other Rights Holders

This research work is devoted to the legal regulation of the circulation of musical works. Chapter 1 sets out the features of a musical work and its protected elements; the main legal stages that the musical works go through before being brought to the end listeners are described and analyzed in detail; features of various types of agreements that mediate the life cycle of a musical work are revealed, namely, a license agreement and producer agreements with music publishers, license agreements with digital distributors and music platforms are described. Chapter 2 addressed some of the issues involved in processing musical works, namely the creation of cover versions, types of cover versions, and the legal nature of sampling. In addition, the issue of using a musical work as part of such a complex object as an audiovisual work is analyzed and some recommendations are given to improve the existing legal regulation in this area.
