International Commercial Arbitration in Russia and China: Comparative Legal Analysis

The master's thesis is devoted to the comparison of the institute of international commercial arbitration in the Russian Federation and the people's Republic of China. Currently, international commercial arbitration is one of the most popular way to resolve commercial disputes in international business. The research considered the main provisions of international commercial arbitration in both countries: the arbitration agreement, the arbitration commission, and the arbitration process. In addition, the recognition and enforcement of foreign arbitral awards in both countries were compared from a theoretical and practical point of view. In research were considered the main differences in the regulation of international commercial arbitration in the "special administrative units" of the PRC – Hong Kong, Macao, and Taiwan. The author highlights the advantages and disadvantages of regulating international commercial arbitration in both countries, as well as suggested recommendations for possible improvement of this institution.
