Recovery of Damages from a Person Having Actual Ability to Determine Actions of a Business Company

In the framework of this work, the author conducts a study of such a phenomenon as actual control over a legal entity. The work examines the issue of recovering losses from the actually controlling person, within the framework of which it substantiates the possibility of legislatively fixing the definition of the actually controlling person, the possibility of correlating the concepts of the controlling person in bankruptcy and the actual controlling person, and determines the legal nature of the liability of the actually controlling persons. The author studies the doctrine of removing the corporate veil in recovering losses from the actually controlling person.
