Voluntary Bankruptcy of Legal Entities

Objectives: The aim of the work is to conduct a comprehensive study of the characteristics of voluntary bankruptcy of legal entities, identify legal problems and suggest possible solutions. Tasks: 1. To reveal the concept of bankruptcy of a legal entity. 2. Consider the legal regulation of bankruptcy proceedings in the Russian Federation. 3. To study the procedures used in bankruptcy cases of legal entities. 4. To analyze the features of the voluntary bankruptcy of legal entities. 5. Identify the problems of legal regulation of voluntary bankruptcy of legal entities and propose solutions. Results: 1. The work reveals the concept of bankruptcy of a legal entity; 2. The legal regulation of the bankruptcy procedure in Russia, the dynamics of changes in bankruptcy law and the impact of such changes on the effectiveness of bankruptcy are considered; 3. Studied the procedures used in bankruptcy cases, the features of such procedures in the bankruptcy of a liquidated debtor; 4. An in-depth analysis of the characteristics of the voluntary bankruptcy of legal entities was carried out, as a result of which the presented conclusions were made about the presence of certain problems of legal regulation. Recommendations: Based on the results of the study, the following recommendations are given in order to increase the efficiency of bankruptcy procedures and, in general, increase bankruptcy efficiency: 1. Exclusion of the observation procedure. 2. In the event of voluntary bankruptcy, the exclusion of the retention of authority from the controlling debtor of the person. 3. Monitoring the timeliness of filing by the debtors of a petition for bankruptcy in case of signs. 4. Conducting by the courts of a mandatory verification of the validity of the creditor's application for bankruptcy of the debtor - legal entity. 5. Establishment of the obligation to hold the first meeting of creditors in bankruptcy of the liquidated debtor and vote on the determination of the bankruptcy trustee.
