Regulation of Contingent Transactions in Private International Law

The paper presents an analysis of a number of problematic issues of the institution of contingent transactions through the prism of Russian and foreign scientific doctrine, judicial practice and legislation. The first chapter examines the concept and features of a condition, as well as the legal status of the parties before the condition occurs. The second chapter delves into the essence of potestative conditions and analyzes the critical problems that arise when using them. The third chapter is devoted to the issues of conditionality of unilateral and dispositive transactions. The research methodology is based both on general scientific methods: analytical, dialectical, historical, structural-systemic, formal-logical, and on special-legal methods: formal-legal, comparative-legal. The purpose of the study was not only to analyze certain aspects of the regulation of contingent transactions in private international law, but also to identify effective solutions for the Russian legislator. Based on the research results, the author presents structured answers to each of the questions posed.
