The Right of Superficies As a Real Right Institute in the Domestic Law

The paper analyzes the historical development of the institution of building law, the foreign experience of the existence of this institution. The author also examines the institution of building law in pre-revolutionary domestic law and Soviet law. The author examines the evolution of building law, starting with Roman private law, and as a result of this evolution, the features of building law in various systems of law. The paper analyzes the features of the legal status of subjects of the right to build and the legal regime of objects of the right to build. Also, as part of the study, the author explores the issues of the basis for the emergence and termination of the right to build. In addition, one of the tasks of this work is to analyze the methods of protecting the right to build from the point of view of the legislation of the Russian Federation. As a result of this work, the author comes to the conclusion that it is necessary to introduce the institution of building law with modern domestic law.
