Legal Protection of the Results of Design Creativity

In the final qualification work was carried out an analysis of existing approaches to the legal protection of the results of design creativity as objects of intellectual property. As a result of the study, the place of clothing design in the intellectual property system was determined, a unified approach to its legal protection was developed, and methods for solving existing problems in this area were found and proposed. The work consists of an introduction, two chapters, a conclusion and a list of sources used. The introduction substantiates the relevance and importance of researching the stated topic, gives a general description of the state of Russian and foreign legislation in the field of protection of design products, sets goals and objectives for achieving them, as well as the methodological basis of work. The first chapter is devoted to clothing design as an object of intellectual property: its properties, features, terminology and the opinions of scientists. Three market segments of clothing were also investigated: haute couture, prêt-à-porter and mass market. On the basis of their features, a possible solution to the choice of one or another form of legal protection is proposed. The second chapter examines the provisions of international treaties regulating the legal protection of clothing design, forms of legal protection of clothing design and their advantages and disadvantages, investigates the problems of legal protection of the design of seasonal clothing collections, and also provides a comparative analysis of approaches to protecting design results in the United States and the Russian Federation. In general, the second chapter proposes a solution to the main issues of the final qualification work. The conclusion summarizes the reflections, also identified problems and solutions are briefly described. The total amount of the work is 52 pages.
