Qualification of Abuse of Power (Art.201 from Criminal Code of The Russian Federation)

This research work examines the corpus delicti under Article 201 of the Criminal Code of the Russian Federation - abuse of power. In particular, it defines all the elements of a socially dangerous act, highlights the most frequently encountered in practice issues, and also touches on theoretical problems, for example, the possibility of criminal prosecution for abuse of powers of an arbitration manager. Based on the analysis of the composition, Article 201 of the Criminal Code of the Russian Federation is distinguished from related crimes. The work contains some suggestions for the application of the article and the interpretation of its elements. Key words: abuse of authority, corpus delicti, interests of service in commercial organizations, management functions, evaluation categories.
