Bankruptcy of the Inherited Estate: Problems of Law Enforcement

The topic of the study is the bankruptcy of the hereditary mass. This theme is cross disciplinary and is considered as controversial. The bankruptcy of the hereditary mass is closely linked to inheritance law and bankruptcy law. This institution of law appeared in domestic legislation relatively recently. That's why the matter is not investigated thoroughly. Currently, the case law and doctrine are ahead of the legislation and set its development vector. The author reviews the litigious points of the article 223.1 of the bankruptcy law and provides court decisions examples (which are) connected with the bankruptcy of the hereditary mass. On the basis of this analysis the author of the work suggests to rename the article title and to introduce a legal term «bankruptcy of the hereditary mass»...
