The Essence and Development Prospects of the Institution of a Compulsory Portion in the Inheritance on the Basis of Russian and Foreign Legislation

The purpose of this work is to systematically research the institution of a compulsory portion in inheritance in Russian and foreign legislation and formulate proposals for changing the current legal regulation of this institution on the basis of the research. The work contains a general legal characteristic of the compulsory portion in the inheritance, identifies and examines the features, advantages and disadvantages of the Russian model of this institution. The models of a compulsory portion in the legislation of France and Germany are also considered in the research, the work consist their features, which are differ from the domestic model. On the basis of the conducted research, the proposals have been formulated to improve the modern legislation governing this legal institution. The work contains conclusions about the need for the development of civil legislation dedicated to the compulsory portion, including the possibility of reforming the domestic institution of the compulsory portion through the partial implementation of regulations from the French and German models.
