Civil-Law Ways of Protection of the Rights of Shareholders

In the graduate qualification work on "Civil law methods of protection of shareholders' rights" the aim was to study insufficiently developed problems associated with the conditions of application and implementation of special civil law methods of protection of shareholders' rights. In this regard, the work consistently examines the theory of civil rights protection methods, in particular, determines the place of the latter in the system of civil rights protection, the legal conditions of application and implementation of special civil law methods of protection of non-property rights of shareholders. The analysis of the identified methods of protection of shareholders' rights is carried out, as a result of which the question of the existence of corporate methods of protection used by shareholders to restore violated rights is solved. The emphasis in the research is made on the analysis of methods of protection of non-property rights of shareholders, in particular, the analysis and generalization of court practice related to the presentation by shareholders of requirements to provide relevant information on the activities of the company, as well as to challenge the decisions of the general meeting of the company. As a consequence, the problems associated with the implementation of the considered methods of protection are identified, our own position on these issues is formed.
