Substantial Change of Circumstances as a Ground for a Court to Intervene into a Contract. Analysis of Russian Law

The paper is dedicated to establishing the conditions for provision of a party of a contract with a right to request termination or adaptation of the contract in case of substantial change of circumstances on which the parties relied when entering the contract under the Russian law and to providing a critical assessment of the rule established under paragraphs 2 and 4 of Article 451 of the Russian Civil Code which prioritizes termination of a contract over its adaptation in case of substantial change of circumstances. The research involves methods of positive legal research, historical legal research and comparative legal analysis.
