Criminal Procedure Features of Preliminary Investigation of Criminal Cases of Crimes Committed on the Internet, Subject to Their Consideration on the Merits in Court in Accordance with Chapter 40.1 of the Code of Criminal Procedure of the Russian Federation

The topic of the final qualifying work "Criminal Procedure Features of Preliminary Investigation of Criminal Cases of Crimes Committed on the Internet, Subject to Their Consideration on the Merits in Court in Accordance with Chapter 40.1 of the Code of Criminal Procedure of the Russian Federation". The final qualifying work consists of an introduction, three chapters (six paragraphs), a conclusion and a list of used literature. The introduction determines the relevance of the research topic, its goals and objectives. The choice of the research topic is due to the fact that the investigation of Internet crimes with the development and complication of the information environment is often complicated by the fact that in some cases it is impossible to identify the person who committed this or that act, since the Internet ensures the anonymity of users. The current Russian criminal and criminal procedural legislation needs a more detailed regulation of such crimes, since many of the existing norms in practice do not find their application in relation to such latent, transnational crimes. The first chapter of the study examines the features of the stage of initiating a criminal case for crimes committed on the Internet. The author examined the content of the pre-investigation check in cases of Internet crimes and revealed the specifics of assessing the results of the collection of the pre-investigation check material and their assessment from the point of view of sufficiency for making a decision to initiate a criminal case. The second chapter "Features of the preliminary investigation of criminal cases initiated on grounds from the Internet" is devoted to the necessary and sufficient urgent investigative actions after the initiation of a criminal case, and such features of the examination of crimes of this category, when concluding a pre-trial agreement on cooperation with the suspect (accused). The third chapter analyzes the features of the preliminary hearing and the mechanism of judicial review of criminal cases on Internet crimes when concluding a pre-trial agreement on cooperation in the order of Chapter 40.1 of the Code of Criminal Procedure of the Russian Federation. In the conclusion, the main conclusions of the study are formulated. The author comes to the conclusion that the conclusion of a pre-trial agreement on cooperation between the accused and law enforcement agencies will serve as a kind of basis, a direction for the timely detection of organized Internet crime, its prevention, prevention and suppression.
