State Control (Supervision) in the Field of Technical Regulation

The overall development of the economy, the protection of life, health and consumer rights, the prevention of man-made disasters, the introduction of new technologies in the country and the reduction of technical barriers to international trade depend on the effectiveness of the implementation of state control and supervision in the field of technical regulation in the Russian Federation. Today technical regulation is used to simplify the ordering of introduced requirements and an overly ramified system of normative acts. These shortcomings lead to a decrease in the effectiveness of state control over the observance of technical regulations. Weaknesses in the regulation of state control, in turn, lead to problems in judicial practice when bringing entrepreneurs to administrative responsibility for violation of requirements. The work developed definitions of the person guilty of violating technical regulations as an administrative offense. The parameters of administrative offenses are proposed, when the violation of the rules of technical regulations is not clearly distinguished from others, different from the elements of the objective side. A proposal was made to establish the grounds for the legality of unscheduled inspection procedures. These scientific proposals are compiled on the basis of data from current judicial practice.
