Procedure for Execution of Decisions of the European Court of Human Rights and Control of Execution

This research aims to reveal how the decisions of the European Court of Human Rights are enforced, as well as how States' enforcement of the Court's decisions is supervised. Although the normative regulation of these legal relations both at the international level and at the level of national legislation of various States is abundant, every year many decisions of the European Court are not executed, or their execution is greatly delayed. Thus, drawing on the legislation and international judicial practice the study seeks to identify the gaps in the procedure for the execution of decisions of the European Court and to propose the most effective mechanisms for monitoring the execution of decisions.In order to provide a full picture of issues at stake, first, the paper analyzes the existing system of enforcement of decisions of the European Court both at the international acts and in the national legal systems. This is followed by a review of the Council of Europe's enforcement bodies and the analysis of the control system itself. The research is concluded by remarks recapitalizing the main findings.
