Administrative Liability in Enforcement Proceedings

The study of administrative responsibility in enforcement proceedings is extremely important, since it touches on unresolved problems both in law enforcement practice and in doctrine. Today, the issue of determining the legal nature of the enforcement proceedings itself remains controversial in the legal system. The paper also raises problematic issues related to the activities of the body vested with the authority to ensure the effective implementation of compulsory enforcement, namely with the jurisdiction of the Federal Bailiff Service. Particular attention is paid here to determining the place of administrative responsibility in the system of legal responsibility for offenses in the field of enforcement proceedings, where the emphasis is on violations of special legislation regulating the normal functioning of the enforcement of judicial acts and acts of other authorized bodies. The analysis and synthesis of law enforcement and judicial practice under article 17.14 of the Code of Administrative Offenses of the Russian Federation was also carried out. The difference in doctrinal approaches, the presence of conflicts in judicial and law enforcement practice determine the relevance and theoretical significance of the topic under study.
