Sociocultural Specifics and Institutions of Conflict Resolution in Business of Japan

Conflict is a fundamental phenomenon, which widespread in all societies and cultures. However, the phenomenon of conflict in Japanese society is quite controversial: on the one hand, it is widely believed that the Japanese, including representatives of business, prefer to avoid conflicts or resolve them by consensus, on the other hand, Japan has long been dominated by a strict and masculine samurai ethic. The general cultural perception of conflicts is directly related to the socio-legal institutions of their resolution. This master's thesis is devoted to identifying the influence of the socio-cultural specifics of the Japanese nation on the development and functioning of conflict resolution institutions in Japanese business. In particular institutions of conflict resolution, such as civil litigation, settlement-in-court, civil conciliation, arbitration, independent mediation, negotiations, the author traces the reflection of the basic categories of Japanese culture. As a result, the state of the modern system of these institutions is explained. The results of the thesis can be useful both for researchers and for lawyers and business representatives working with Japanese colleagues.
