The Protection of the Rights of Patent Holders under the Legislation of the Russian Federation

The problem of protecting the rights of patent holders in recent years has become particularly relevant. This is due to the high rate of scientific and technological progress, as a result of which unscrupulous persons acquire more and more opportunities for the illegal use of other people's patents. The purpose of this study is to analyze the institution of protection of exclusive and personal non-property rights of patent holders for its effectiveness and consistency, taking into account the specifics of patent law. The author examines the materials of judicial practice in order to identify the most frequent violations of the rights of patent holders and the dynamics of the courts' resolution of disputes in favor of the applicant.
