Trust Management of Property: Problems of Theory, Legislation and Judicial Practice

Trust management of property can be characterized as a special civil law institution due to the presence of specific features, as well as the peculiarities of its formation in Russian law. Also, it is noted that relatively recently, the legislator was given the opportunity to transfer the inheritance property to the trust management. In general, the legal institution of trust management of property is relevant for scientific research, since it causes active scientific discussions regarding some problems of a theoretical, legal and practical nature. Within the framework of this study, the features of the origin of trust management of property and the history of its formation in national law are considered, the legal nature of trust management is established, and aspects of the contract of trust management of property are disclosed. Also, scientific attention is devoted to the identification and research of current problems of trust management of hereditary property and property used in business activities. This study attempts to reveal the concept of a trust management agreement as an entrepreneurial agreement.
