Features of Labour Regulations of Minors

Issues related to the prevention of child labour are relevant not only nationally, but also internationally. According to the International Labour Organisation, 152 million children worldwide are subject to forced labour. Therefore the employment of underage workers as well as the use of child labour during the COVID-19 pandemic is of particular importance for the global community as many families lose their income and children are forced to work. Underage workers, as special subjects in the labour force, require special protection by the state and society at large. Research shows that at the moment in the Russian Federation not all employers faithfully follow the norms of labour law when employing underage workers. Therefore, in order to ensure protection by the state, it is necessary to improve existing legislation. This paper examines issues related to the prohibition of child labour and the specifics of legal regulation of the labour of underage workers at the Russian and international level. The purpose of this study is to provide a comprehensive analysis of the legal regulation of child labour under international law and Russian law, including consideration of child labour, and to identify the main problems in the process of abolishing child labour. The study analysed the legal labour of underage workers, which is regulated by the Labour Code of the Russian Federation, as well as the prohibited use of labour, which is understood to be child labour. In the Russian Federation, cases were identified where employers did not comply with labour law norms in labour relations with underage workers, and labour law norms that have an adverse effect on the labour of underage workers were also identified. Also, a study on child labour around the world provided possible solutions to the problem of abolishing child labour. Child labour is a form of exploitation of child labour. The problem of child labour is a global one and therefore all countries need to join forces to combat it, develop the social and economic sectors of lagging countries and increase accountability in the use of child labour. First of all, to raise public awareness of the importance of the problem and the need to eradicate it; then to carry out legislative and educational measures, and to provide material and psychological support to children and their parents. The actions outlined in this study, which not only concern legislative changes but also the joint struggle of countries in different areas to combat child labour, will help to achieve the Alliance's target 8.7 to eradicate all forms of child labour by 2025 in the most effective way.
