The Ethics and Law Regulation of Novel Reproductive Technologies

Assisted reproductive technologies (ART) are among the most widely used and successful medical technologies. ART give hope to millions of infertile couples for a full-fledged family. Despite the popularity and breadth of application, there are still certain legal and ethical problems that require both discussion and early solution. The first chapter of the work is devoted to the historical analysis of the emergence of assisted reproductive technologies and the existing types of ART. This chapter analyzes the options for the legal definition of ART and the emerging difficulties from a linguistic point of view. The second chapter is devoted to the analysis of modern domestic legislation and judicial practice on the use of ART. In addition, it examines the legislative regulation of ART in the USA, Europe and Muslim countries, as well as the practice of the European Court of Human Rights. Such analysis makes it possible to identify existing problems and ways to solve them by modernizing legislation and bringing it into line with existing moral and ethical principles. The third chapter of the work is devoted to the ethical aspects of the use of reproductive technologies. In the conclusion, we list those problems and methods for their solution, which became a natural result of this work. Russian, international and foreign legislative acts, domestic and foreign judicial practice, statistical data, articles in Russian and English were used for that thesis paper.
