Commercial Courts in the International Financial Centers

This paper is devoted to the study of commercial courts in International financial centers. Globalization has helped to establish and strengthen economic ties, resulting in the emergence of international financial centers, where the rights and interests of companies are protected by the commercial courts of the centers. The main purpose of the work is to determine the legal status of commercial courts in international financial centers, the specifics of the organization of the judicial process and the mechanism for the execution of court decisions based on the analysis of the existing doctrinal and regulatory framework, judicial practice and experience of various countries. The work is aimed at studying and analyzing scientific approaches to determining the legal status of commercial courts of financial centers, the concept and limits of the jurisdiction of commercial courts, the features of the formation of the composition and structure of commercial courts in international financial centers, the mechanism for the execution of decisions of commercial courts, the procedural features of the organization of judicial proceedings in commercial courts, regulatory legal acts regulating the activities of courts of financial centers. To solve the tasks set in the work, the following methods were used: system analysis, classification, analogy, description, ascent from the abstract to the concrete, comparative legal method. The structure of the study: introduction, the main part, which consists of the first chapter (two paragraphs) and the second chapter (four paragraphs), conclusion and bibliography. As a result of the study, the following results were achieved: the definition of the concept and limits of jurisdiction in the case of an international financial Center, the proposal of the concept of "conditional jurisdiction", as well as amendments to international acts that simplify the mechanism for the execution of commercial court decisions, the identification of general patterns of functioning and formation of commercial courts in international financial centers, the identification of the competence of commercial courts, and the types of commercial disputes subordinated to commercial courts in international financial centers.
