The Regulatory and Monitoring Powers of Administrative Agencies with Regard to Entities of an Entrepreneurship

Nowadays, the problem of an interaction between representatives of public authorities and private entities engaged in entrepreneurial activity is relevant not only personally for these entities, but also for constitutional and legal reality in general, and therefore the topic of this study is the topic of regulatory and control powers public authorities in relation to business entities. Within the framework of the study, an analysis of the regulatory and control powers of the authorities in relation to business entities was carried out in the following forms of interaction: state registration of persons pursuing the purpose of carrying out entrepreneurial activities; the establishment of mandatory requirements for certain types of entrepreneurial activity; and also, in the procedures for monitoring compliance with regulatory requirements established by the state. The aim of the study is to determine the powers of public authorities in the implementation of the listed forms of interaction. In order to achieve the goal, it is necessary to establish the degree of normatively permissible interference of the public sector in the activities of private entities and the cases of such interference that are present in practice. In the development of the goal, it is proposed to classify the powers of regulation and control according to the criterion of their semantic content. In addition, the work considers the novelties of legislation introduced in the framework of the Administrative Reform - in relation to control and supervision activities and activities to establish mandatory requirements. The investigation contains various positions of researchers and current cases of law enforcement practice. Based on the results of the study, proposals were made to supplement the provisions of the current legislation with a number of definitions of legal categories.
