Restrictions on the Exercise of Exclusive Rights in the Digital Economy

The thesis investigates the problem of limiting the exercise of exclusive rights in the digital economy. Building a digital economy is impossible without the effective functioning of the institute of intellectual property. Exclusive rights to the results of intellectual activity and means of individualization are a significant share of the assets of digital markets. The welfare of society and the level of economic development of the state depend on the effectiveness of their legal regulation. The existing civil law mechanisms are largely outdated, and the feasibility of applying antitrust legislation to the field of intellectual property is the subject of many years of discussion. The author comes to the conclusion that it is necessary to develop a new comprehensive approach to the regulation of restrictions on the exercise of exclusive rights, which can ensure a balance of private-public interests in society.
