State Supervision of Law Enforcement in the Field of Advertising

The research is devoted to the analysis of advertising activities, as well as procedural issues of state regulation of this area. The relevance of the research is due to the fact that the market of advertising activities is actively developing: every day there are more sites where brands can promote their products, but the state supervision of the lawfulness in the field of advertising remains the same - the federal legislation on advertising, although constantly changing, does not take into account the regulation of all opportunities to promote the brand. The effectiveness of government regulation is a frequent topic of discussion in the community, as is the effectiveness of advertising self-regulatory organizations. This paper considers the formation of the Russian system of advertising regulation, the aspect of modern regulation of this sphere, as well as disputed issues regarding the definition of advertising as an object of administrative and legal regulation and procedural legality assurance in the field of advertising. As a result of the study some problems of definition of advertising as an object of legal regulation, as well as problems associated with the procedural aspect of ensuring the legality in this area were identified, and ways to improve legislation in this area were proposed.
