Corporate Regulation\'s Impact on the Conclusion and Contents of Cross-Border Commercial Contracts

The world economic system is undergoing significant changes due to the influence of global trends. Business communication and legal regulation of basic business processes are changing. Globalization and informatization of the economy play a significant role. Accordingly, the approaches to the conclusion of cross-border contracts are changing. In the light of the above reasons, the problem of the influence of internal corporate regulation seems to be relevant. This study is intended to reflect the specifics of the approaches developed by companies to the preparation of an international commercial contract through the analysis of internal corporate documents and procedures, as well as to establish the influence of the organization's internal corporate regulation on the conclusion of an international commercial contract. The object of this study is the sources of regulation of international commercial contracts, as well as acts of legal entities that affect the implementation of foreign economic activity. The subject of the research is the tendencies and patterns that are characteristic of cross-border relations that develop in connection with the conclusion and execution of a cross-border commercial contract. The following methods were chosen for this research: methods of systemic, logical and functional analysis, complex historical methods, methods of formal legal and socio-legal analysis, methods of interpreting legal ideas and regulatory legal acts, methods of legal statistics, comparative legal research. The scientific novelty of the study lies in proposing a new expanded concept of corporate regulation, reflecting the influence of the company's internal documents on conclusion and content of international commercial contracts. The relevance of the study is predetermined by the strengthening of the role of cross-border trade in the modern economy and the increasing complexity of the structures of corporate regulation.
