Legal Regulation of the Labor of Foreign Workers in the Russian Federation

The 30 years that have passed since the collapse of the USSR have radically changed the appearance of the space occupied by it for more than 70 years. The uneven economic growth of various countries, provoked by the disintegration and intensified by the processes of globalization, and the emergence of interethnic, social, and international conflicts in this regard, have led to the intensification of migration processes in the world in general and in the Russian Federation in particular, processes that are directly and closely related to the labor sphere, since the search for decent work that can provide a better life is the main cause and purpose of migration of citizens. The adoption of laws regulating these processes does not always keep up with the processes themselves, despite the fact that, in principle, in this field, lawmaking work should go ahead of them. The purpose of this final qualification work is to study the peculiarities of the legal regulation of labor relations with migrants coming to Russian Federation for the purpose of employment, to identify legal problems in this area, the causes of their occurrence and to find ways to resolve them. Seven categories of foreign citizens residing in Russia and differing in their legal status were studied in terms of the algorithm of their employment and the features inherent in each of the algorithms. As a result of the study, the features of the legal regulation of labor relations with foreign employees and the difficulties that arise common to all categories in employment related to gaps, contradictions or imperfections of existing legislation were identified, and ways to overcome the identified difficulties were proposed. The most effective way to optimize and simplify the legal regulation of labor relations with foreign workers is the development and adoption of a new Migration Code that can combine and systematize the dozens of regulatory legal acts that currently regulate the processes in this area.
