Impact of Sanctions on International Commercial Arbitration

The thesis is devoted to exploring the sanctions limitations which have effect on international commercial arbitration. During the analysis of the impact of sanctions on international commercial arbitration the following questions were studied: the arbitrability of disputes which involve sanctioned persons, the neutrality of arbitrators and arbitral institutions when arbitrating disputes which involve sanctioned persons, related to the EU and US sanctions regimes difficulties in paying arbitral fees, hiring legal counsel and participating in arbitration proceeding in person. The work also analyses and evaluates in terms of effectiveness different solutions to the identified problems, such as choosing Asian arbitration institutes and the application of the new provisions of the Russian Arbitrazh Procedure Code.
