Pre-trial Dispute Settlement Procedure in the Arbitration Process

The legal regulation of modern economic relations is particularly complex, including when resolving legal conflicts in court. The relevance of the research topic lies in the fact that the legal regulation of the pre-trial dispute resolution procedure has a number of law enforcement problems that stand in the way of the effective use of this institution. Unresolved legal conflicts of norms that determine the procedural order of pre-trial settlement of disputes in the arbitration process lead to a problem in judicial practice. The practical significance is expressed in the study of law enforcement problems that arise in the judicial practice of arbitration courts, when considering disputes about the observance of pre-trial procedure by participants in economic legal relations. On the basis of the analysis, brief prospects for the development of the institute of pre-trial dispute resolution procedure and the procedure for eliminating legal gaps in the current legislative regulation are formulated.
