Educational Programme: Jurisprudence (Bachelor)

Year of Graduation: 2021

This paper is devoted to the study of the concept of real estate ownership in Russian law, in order to determine the best model for the turnover of real estate ownership due to its physical properties and mandatory registration. The first chapter examines the view of ownership as the actual control of a person over a thing, followed by an analysis through the prism of civil law institutions. In the second chapter, the concept of ownership as a book record is analyzed, and its critical assessment is given for possible integration into the current legal order. In addition, the paper presents the historical development of the institute of ownership in Russian law. As a result of the study, the ownership model as a fact was preferred, since it seems to be the most painless way for law enforcement to integrate real estate ownership.
