Qualified Legal Assistance Provided by a Lawyer to Minors

This research focuses on the provision of qualified legal assistance to minors. This issue is relevant for today. This conclusion can be made on the basis of the following: at present in the Russian Federation a considerable number of crimes are committed by minors. At the same time there is an increase in the number of grave and especially grave crimes. Thus, at the end of 2019, for forty thousand established cases of violation of criminal law committed by juveniles, one quarter are serious and especially serious crimes, which is ten percent more than in the previous year. Speaking about the total number of cases of juvenile crime, most of the crimes were committed against property, life and health, including drug trafficking. The legal consequence of violation of criminal law is prosecution and application of respective measures. Because of their age and social status, minors cannot properly protect their legal rights and interests. The minors can be assisted by their legal representatives as well as by the institution of the Bar, in particular the lawyer. The diploma thesis consists of an introduction, two chapters, five paragraphs and final conclusions. The main part of the work is devoted to analysis of advocate's activity in rendering qualified legal assistance; determination of his status depending on the stage of criminal, civil, administrative and other cases; definition of the concept of "qualified legal assistance", since not every legal assistance is qualified. The aim of the work is a comprehensive study of qualified legal aid to minors in criminal, civil, administrative and other processes. The object of the research is a complex of legal relations that arise during the provision of qualified legal assistance by a lawyer to the minor. The subject of the study is the norms regulating the advocate's activity and defence of a minor.
