The Role of Possession in the Transfer of Title to Immovable Property

It is not enough just to have ownership of an immovable property and the desire to transfer this right; in order for the property right to be transferred, a legal structure is needed. The relevance of the chosen topic is based on the absence of the institution of ownership and proprietary protection in Russian law, as well as on the attempts made by the legislator to reform the property law over the past 10 years. Within the framework of this study, an analysis of various approaches to the essence of possession will be carried out, the theoretical justification of possession as a fact or as a right (a special case is an entry in the register) will be considered, and the role of transferring possession under a valid and invalid real estate purchase. The object of the research is property relations that develop in the process of transferring possession from one person to another as part of the transfer of ownership of real estate. The subject of the research is the legal norms contained in Russian legislation governing such legal relations, as well as the practice of their application and relevant doctrinal provisions.
