Professional Legal Assistance of an Attorney in Criminal Cases in the Russian Federation

The study covers various problematic aspects of qualified legal assistance by lawyers in criminal proceedings, such as the absence in legislation describing the procedure for collecting and securing evidence by a lawyer during criminal proceedings, the actual absence of adversarial parties both at the pre-trial and judicial stages of criminal proceedings, cases of unjustified duplication by the defense by appointment of protection by agreement and others. In this regard, the work carried out an analysis of international legal standards for advocacy, the provisions of domestic legislation, the positions of domestic higher courts regarding advocacy, as well as research by the Federal Chamber of Lawyers and the International Commission of Lawyers.
