The civil legal regime of genetic information

The purpose of this work is to substantiate the possibility of using genetic information as an object of civil rights. The study determines the legal nature of genetic information. In the course of the study, the problems of legislation and law enforcement practice were identified. First of all, it was revealed that there is no universal concept of genetic information in Russian legislation. In addition, there are currently no appropriate ways to protect against unauthorized use of genetic information. As a result of the study, various approaches to the place of genetic information in the system of objects of civil rights were considered, and the need to develop a special legal regime for its protection was identified. It seems that this study will complement the existing comprehensive studies in terms of substantiating the possibility of the participation of genetic information in civil circulation. The theoretical and practical results of the research are: solving the question of the legal nature of genetic information; identifying the possibility of applying general methods of protection (Article 12 of the Civil Code of the Russian Federation) in relation to the rights to genetic information; conducting a comparative legal analysis of the legal regulation of relations on the use of genetic information.
