The institution of bankruptcy is becoming the most popular in an unstable economic situation, which in turn requires modernization. At the same time, in case of insufficiency of property in the bankruptcy estate, difficulties arise with the satisfaction of the interests of each creditor of the debtor. The aim of the research is to study the rules for the formation, implementation and distribution of the bankruptcy estate in the process of insolvency (bankruptcy). When writing the final qualifying research, special legal or legal methods were used, such as comparative legal methods for comparing different norms and their further analysis, as well as the method of legal analysis. It is assumed that the work will propose ways to solve the existing problems of legislation, consider the procedure for including objects of law in the bankruptcy estate, consider the problems associated with the sale of the bankruptcy estate, as well as the peculiarities of the distribution of the bankruptcy estate among creditors. The practical value of the final qualifying research is that some changes will be proposed to the legislation of the Russian Federation on bankruptcy, which would eliminate a number of problems that arise during bankruptcy proceedings.
